State of Minnesota in Supreme Court C8-00-2227 Court of Appeals “As a matter of law, a reasonable child is incapable of knowing that he or she has been sexually abused. Absent some other disability that serves to delay the running of the statute of limitations, the six-year period of limitation provided in the delayed discovery statute, Minn. Archibold White Plains “Without naming any churches or priests or issuing any indictments, a Westchester County grand jury investigating the sexual abuse of children by Roman Catholic priests released a report today accusing churches of cover-ups and urging state lawmakers to eliminate the statute of limitations on child sex-abuse cases. Child Abuse Bill Passes – Agencies doing business with Suffolk must report allegations By Valerie Burgher 6/12/02 “Suffolk lawmakers yesterday passed a bill requiring agencies doing business with the county to report suspicions of child sexual abuse to Child Protective Services….The new initiative specifically requires religious institutions to inform the abuse registry of any knowledge they may have of sexual abuse of children. from LMS Escaped convict, 70, done running after 31 years Larry Oakes 5/31/02 “But in 1970, the stepdaughter, then 17 years old, recanted, telling a judge she made up the rape allegations to get even with Severs for beating her and to punish her parents for fighting. “I didn’t think he’d go to the penitentiary,” she said…Instead of vacating the conviction or ordering a new trial, Judge Charles Owens found that her recantation was a lie and had her charged with perjury….her new testimony didn’t fit other evidence that supported her original testimony…Sharon Severs said that the recantation was indeed false…she made it because she wanted to get married. Silently Shifting Teachers in Sex Abuse Cases – By Diana Jean Schemo 6/18/02 The New York Times “When teachers are accused of sexual abuse…districts often rid themselves of the problem by agreeing to keep quiet if the teacher moves on, sometimes even offering them a financial settlement…avoids the difficulties of criminal prosecution or protracted disciplinary proceedings. But districts on the receiving end of such transactions have begun suing the originating districts for civil damages when the teacher abuses again. So have the victims. Legislatures are…mandating fingerprint and criminal record checks of teachers and protecting employers who give unfavorable references from lawsuits…. Charol Shakeshaft…at Hofstra University, studied 225 sexual abuse complaints against teachers made to federal authorities from 1990 to 1994 and found that in only 1 percent of the cases did superintendents follow up to ensure that molesting teachers did not continue teaching elsewhere…Of the 121 teachers removed this way, administrators knew for certain that 16 percent resumed teaching in other districts.”

From LMS Principal Sues the Diocese of Brooklyn, Citing Abuse By Anthony DePalma 6/20/02 “The principal of a Catholic school in Ozone Park, Queens, whose pastor is under investigation by the Queens DA’s office has filed a sexual harassment suit against the Diocese of Brooklyn, charging that for more than 18 months church officials did not respond to her complaints that the pastor intimidated and verbally abused her with sexually explicit language. The complaint, filed…in State Supreme Court in Queens, alleges that the pastor, the Rev. John Thompson of St. Elizabeth’s parish…boasted of his homosexual relationships, describing in detail his activities with an 18-year-old man who lived in the parish rectory in 2001. Spreading Scandal 6/9/02 “At least 300 civil lawsuits alleging sex abuse by priests have been filed in 16 states since January, and lawyers say several hundred more cases are being informally mediated between dioceses and accusers. Estimates of what the church has paid out since the first major scandals broke in the 1980s range from about $300 million to $1 billion. Jury Tells of Abuses by Priests New York Daily News – 6/19/02 – By Richard T. Pienciak – “A Westchester County grand jury issued a damning report…that details numerous instances of sexual abuse by Archdiocese of NY priests and accuses church officials of chronically covering up clear-cut cases of criminal behavior….Not a single instance was discovered where church officials reported sexual misconduct allegations to law enforcement. The panel noted that it also failed to find a single church official who had ever recommended that the victim file a report with police.”

Sun 6/9/02 “The Roman Catholic Church has removed 218 priests from their positions this year because of allegations of child sexual abuse, but at least 34 known offenders remain in church jobs, according to a survey of Catholic dioceses across the US by The … Post….Post survey found only $106 million in acknowledged payments. Plaintiffs’ lawyers say that the true figure is in the range of $1 billion…most of the settlements have been made under confidentiality agreements. The survey found that 866 priests have been accused of child sexual abuse over the past four decades, less than 1.5 percent of the estimated 60,000 or more men who have served in the Catholic clergy over that period….Sylvia Demarest, a plaintiff’s lawyer in Texas…compiled a database in the mid-1990s of about 1,200 priests who were accused of sexual misconduct with minors …she believes the current figure is higher than 1,500. A.W. Richard Sipe… estimates that 6 percent of all U.S. priests have committed child sexual abuse. Exposed: The clause that contradicts Pell By Frank Walker 6/9/02 The Sun-Herald “A disabled woman who said she became pregnant after being raped by a Catholic priest had to sign a secrecy clause before the Church would pay her $15,000…authorised by a NSW bishop last month, contradicts Sydney Archbishop George Pell’s statements that victims were not prevented from discussing such abuse… If she did talk, the document says, she would have to repay the $15,000. Dr Pell has said victims are not prevented from discussing the abuse they had suffered. Jailed Polygamist Can Be Tried in Child Rape Case LA Times 6/18/02 “Prosecutors in Salt Lake City can try avowed polygamist Tom Green on child rape charges for having sex with one of his wives when she was 13…Attorneys…had argued that the two had sex in Mexico and that Utah authorities have no standing to prosecute the crime…Judge Donald Eyre said there is evidence that Green and the girl’s mother hatched a “criminal conspiracy” in Utah, so prosecutors in this state can pursue the charges.”

Nearly 100 Kentucky Men Add to Accusations Against Priests – By Francis X. Clines “…since Mr. Turner went public with a lawsuit against the Archdiocese of Louisville, this heavily Catholic area has been shocked to see more than 90 men bring shame-steeped complaints against 14 priests, a deacon and a lay parochial school teacher. Area bishop discloses past sex abuse cases – By Maureen Hayden, Courier & Press staff – 6/5/02 “Evansville – The Roman Catholic bishop in Western Kentucky revealed…that he put priests back into active ministry after they admitted to sexually abusing children. Conn. judge’s opinion on the release of documents by the Bridgeport Diocese – In a written opinion (released 6/12/02), Conn Superior Court Judge Robert F. McWeeny accused his state’s judiciary of complicity in the Bridgeport diocese’s efforts to keep documents concerning sexual abuse by clergy from the public view….The church’s sexual abuse scandal has not been exposed by the courts. Roman Catholic Church Shifts Legal Strategy Aggressive Litigation Replaces Quiet Settlements By Michael Powell and Lois Romano 5/13/02 “…the diocese charged in a countersuit that it was she who was negligent for allowing her boys, then 7 and 10, to sleep over at the sacristan’s apartment….The 194 Catholic dioceses in the US…do not possess limitless resources – some estimates put their net worth at about $15 billion. The church and its insurers have already paid out an estimated $1 billion in settlements – obtained from the sale of assets and from special church “abuse or molestation” liability insurance coverage. Hidden Evidence? Bishop Caught on Tape Suggesting Concealing Abuse Evidence By Brian Ross 5/31/02 “The Vatican’s American embassy may have played a key role in keeping secret the scope and seriousness of the priest sexual abuse problem and of the millions of dollars in church money used to keep the scandal quiet….In a tape obtained by ABCNEWS, the auxiliary bishop of Cleveland, A. James Quinn, was recorded in 1990 telling a seminar of church leaders and lawyers to destroy any anonymous allegations when sex-abuse allegations arise. “Personnel files should be carefully examined to determine their content. Parish issues apology after priest tells congregation to report abuse only to archbishop By Judy L. Thomas – 5/14/02 – Kansas City Star “An associate pastor at a Roman Catholic Church in Lenexa recently urged parishioners not to report abuse or attempted abuse of minors to authorities, but to tell only the archbishop. According to parishioners, the Rev. Bala Swamy told children attending Mass on May 5 at Holy Trinity Catholic Church that if a priest attempted to molest them, they should say “no.” If abuse did occur, parents were told they were to go to Archbishop James P. Church paid off Chicago priest 6/18/02 by Steve Warmbir, Cathleen Falsani “The Roman Catholic Archdiocese of Chicago agreed to pay a priest dogged by allegations of sexually abusing boys a $200,000-plus settlement as he left the church, according to court records and interviews. The contract came to light during a search…of former priest Vincent McCaffrey as investigators looked for child pornography in his home. Files show church leaders knew of abuse for decades – 05/17/02 Jennifer Levitz – “Providence – Newly released documents…show that church officials as high-ranking as the late Cardinal Humberto Medeiros knew decades ago that now-defrocked Fall River priest James Porter had been accused of molestation. Hundreds of pages of personnel files on Porter…indicate that bishops failed to act on early warnings that sexual abuse by priests was becoming a problem…The files show that Porter himself wrote to Pope Paul VI in the 1970s, alluding to troubles that had plagued him in North Attleboro and followed him to Fall River. ABC: Wis. Bishop Settled Sex Claim – 5/23/02 – Milw. – Archbishop Rembert Weakland, who has adopted a zero tolerance policy toward abusive priests, agreed in 1998 to pay $450,000 to a man who accused him of sex assault, according to documents cited…by ABC News. The report came a day after the RC bishop of Lex., Ky., temporarily stepped aside from his…duties in the wake of a lawsuit filed by a man for alleged sexual abuse. As a part of the brain called the amygdala is critical for learned fear in adult animals, we investigated whether the development of learned avoidance behaviour could be delayed by late maturation of amygdala function. We found that very young rat pups exposed to various odours associated with shock treatment learn an approach response to that odour, whereas older pups learn odour avoidance. We show that the origin and development of learned odour-avoidance behaviour is associated with enhanced neural responses in the amygdala during odour-shock conditioning.”

Debunking Frontline’s – Did Daddy Do It? “”Frank Fuster was living the American dream.” Or so claims Frontline…for the 4/25/02 program, “Did Daddy Do It?” Fuster had “a new house in the suburbs, a successful landscaping business, and a new wife.” Then, according to the highly-acclaimed PBS program, Fuster “found himself” charged with sexually abusing children in their home day care. His subsequent conviction, considered ironclad by many, was the target of this hour-long program. But Frank Fuster was not living the American dream. He was on probation for a 1982 child molestation conviction for a lewd and lascivious assault on an nine-year-old girl. Fuster also served four years in New York for manslaughter, after shooting a man in after a traffic accident and then threatening an off-duty policeman with his loaded rifle.
