More than 4,500 lawsuits representing at least 12,000 claimants have been launched since the federal government officially apologized in 1998 for widespread abuse. New abuse is alleged at Malvern Prep – Authorities are investigating a student’s accusation of sexual misconduct against a priest at the Chesco school by Kathleen Brady Shea and Jonathan Gelb 1/15/03 West Chester – Chester County authorities are investigating a new allegation of sexual misconduct by a priest at the prestigious Malvern Preparatory School. John Molloy, 44, sexually assaulted a boy who was under the age of six, at the curate’s house in the parish where he was ministering in 1985. Ten charges, including abuse of a girl in 1959, remain on file. The leader of the Catholic Church in England and Wales, Cardinal Cormac Murphy- O’Connor, has struggled to explain why he gave Hill a job as a chaplain at Gatwick airport despite warnings from parents that the priest was a danger to children. Police are investigating the cardinal in connection with issues arising from Hill’s case. Pope given priests `sex time bomb’ warning 30 years ago by Roger Dobson and Maurice Chittenden in The Sunday Times – 12/23/02 “The present Pope was among several Catholic bishops warned in a secret report more than 30 years ago that the church faced a potential “psychosexual” time bomb in the priesthood. The report, which foreshadows the scandals over sexual abuse of children which have erupted in the church in recent years, was prepared for a synod of bishops at the Vatican in 1971. Its authors estimated that a quarter of clerics had psychiatric difficulties and most were emotionally immature….unpublished report by Dr Conrad Baars, a Dutch-born Catholic psychiatrist from Minnesota, based on the records of 1,500 priests treated for mental problems. Baars reported that “psychosexual immaturity expressed in heterosexual or homosexual activity was encountered often. Virtually all of these priests were…suffering from a severe to moderate frustration neurosis”. The report, The Role of the Church in the Causation, Treatment and Prevention of the Crisis in the Priesthood, estimated that less than 15% of all priests in western Europe and North America were emotionally fully developed. Of the rest, 20-25% had serious psychiatric difficulties that often showed themselves in alcoholism; 60-70% suffered from lesser degrees of emotional immaturity. Judge Voids Sexual Abuse Suit Against Vatican AP St. Petersburg, Fla., 11/28/02 “A suit accusing the Vatican of covering up sexual abuse is prohibited because the statute of limitations has run out, a judge has ruled. Eight young complainants are involved, six of them boys. Some of the counts are laid under a section of the Crimes Amendment Act that was introduced in 1995 to stamp out sex tours by New Zealanders to places such as Thailand and the Philippines. It means the same penalties can be imposed as if the offences were committed in this country. SJC considers statute of limitations in clergy abuse cases 2/6/03 Boston (AP) “The state’s highest court heard arguments…on whether a lawsuit brought by a woman who claimed she was abused by a priest as a teenager more than four decades ago should at least be heard by a jury under the state’s statute of limitations. State law gives a person three years to file a lawsuit after they turn 18, but the law allows people more time if they did not make the connection between the alleged abuse and damage suffered as a result of it until later. Sexual abuse suit dismissed against school 1/10/03 by Linda Stein “Trenton – A former student at the American Boychoir School in Princeton Borough who sued the school over sexual abuse he allegedly suffered there as a child was devastated to learn that a judge has dismissed that lawsuit he filed against the school…..In his 40-page opinion, Sabatino said the Charitable Immunity statute protects nonprofit corporations, religious and educational organizations from liability for damages “for the negligence of any of its agents,” provided the injured person is a “beneficiary.”….However, the school had previously settled two other lawsuits with similar allegations, one for $850,000.” http://www.nj.com/news/times/mercer/index.ssf?/base/news-4/1042196443152792.xml

The Diocese of Manchester said it accepted the resignation of Rev. N.H. Bishop: Some Priest Sex Less Serious 12/23/02 Concord, N.H. (AP) – “Questioned under oath about the church abuse scandal, New Hampshire’s bishop suggested that it is less serious for a priest to have sex with someone from outside the parish than with a parishioner. In depositions this fall, Bishop John B. McCormack said he knew the Rev. Roland Cote had had sex with a teen-age boy but noted that the boy was not a parishioner. “You know, one is an activity where you have a trusted relationship with a parishioner. The other is an activity where you’re away from the parish and you’re off on your own,”‘ McCormack said in depositions obtained by …AP… “I’m very concerned about that; he was a young person. 16 priests named for first time in sexual abuse lawsuits At least three still active; total of accused at 130 by Michael Rezendes, Matt Carroll, 1/30/03 “The new lawsuits, filed on behalf of 70 new alleged victims, include charges of rape, attempted rape, and fondling of minors against 40 priests and a former church worker who is believed to be a deacon…Also named as defendants in some of the suits are two former auxiliary bishops in Boston, Archbishop Daniel A. Cronin of the Hartford archdiocese and Bishop Daniel A. Hart of the Norwich, Conn., diocese. They bring to eight the number of bishops, including Cardinal Bernard F. Law, who have been accused of negligence while they supervised the abusive priests. Michael Smith Foster, the Boston Archdiocese’s top canon lawyer – knew of multiple allegations against Pope John XXIII seminarian Mark Doherty but nonetheless acquiesced in allowing him to be ordained in the Diocese of Charlotte, N.C. “After consultation with my canonical advisors, I write to suggest that the easiest way for this to go forward would be simply to wait out the necessary five years and then proceed if you so decide that way,” Law wrote to Bishop William G. Curlin on Aug. 23, 1999….The Rev. Six weeks after its adoption, he was seeking an exemption for the Rev. Raymond C. Plourde. McCormack thought Plourde should remain as pastor of his Newburyport parish even though he had admitted to molesting a 12-year-old boy. An archdiocesan review board sharply disagreed. “For the good of the church,” it concluded, “he priest must resign.” Plourde became a convent chaplain until his retirement last year….Discretion, the records make clear, was the key. Lawyers for Boston Archdiocese Subpoena Alleged Victims’ Therapists – Boston 1/17/03 – “Lawyers for the Boston Archdiocese, which offered to pay for counseling for people who say they were abused by priests, have begun issuing subpoenas to the therapists to get details about the sessions. Shanley resigned his position at a Newton church and moved to a California parish, it fell to Bishop Robert J. Banks, then the top administrator in the Boston Archdiocese, to write a 1990 letter assuring California church officials that Shanley was a priest in good standing. But in pretrial testimony released yesterday, Banks acknowledged that when he wrote the letter, he had been told of allegations that Shanley had spoken in favor of sex between adults and children and had allegedly initiated a conversation about sadomasochism with a patient while serving as chaplain at McLean Hospital…”At the time I wrote the [1990] letter, there was no obvious indication that Fr. The Boston Files By Rita Ciolli and Joseph Mallia “In 1995, Bishop William F. Murphy, then the second-highest ranking official in the Archdiocese of Boston, faced a grave problem: One of his priests was accused of sexually molesting a boy at a church-run juvenile detention center. Murphy decided to allow the Rev. C. Melvin Surette to remain active and then gave the cleric $14,000 to start a job bank to find work for other priests accused of abusing children. Murphy also gave Surette an allowance to live in private housing and extra money for a car and parking expenses. Lennon tied to priest probe: Foster case memo shows bishop was at meeting by Robin Washington and Tom Mashberg 12/26/02 Boston Herald “Church records show Bishop Richard G. Lennon, the interim leader of the Archdiocese of Boston, attended a two-hour meeting on the fate of an accused priest – even though Lennon publicly denied having any role in the case. A memo in the file of Msgr. 15 Men Reach Settlement on Abuse Claims AOL 1/10/03 Boston (AP) – “Fifteen men who said they were abused by clergy who taught at two Jesuit-run high schools in New England have settled their claims…Attorney Roderick MacLeish…the settlements totaled $5.8 million and ranged from $75,000 to more than $1 million. Eleven of the men claimed they were abused while they were students at Boston College High School in the 1970s and early 1980s. Ten men named the Rev. James F. Talbot, a hockey and soccer coach, and the other cited the Rev. Francis J. McManus.”

Robinson, 12/29/02 “By the time Needham police arrived at the modest split-level home at about 5 a.m., the 41-year-old woman was dead….Now, the four siblings know from church records that their mother, who was severely depressed, was a victim of yet another priest whose sexual misconduct was overlooked by his superiors. They know that the Rev. James D. Foley began a long and destructive affair with her after she went to him for counseling in the early 1960s. They also know that Foley was with their mother that night in 1973, that he put his clothes on and left when she passed out from the pills, and that she died naked and without help – just a mile and a half from Glover Memorial Hospital….they also cannot comprehend why Cardinal Bernard F. Law and Bishop John B. McCormack decided to keep Foley’s secret and return him to a parish after they learned in 1993 how their mother died. The Association of Family and Conciliation Courts in Colorado in 1990 surveyed custody-visitation disputes involving 209 alleged child-sex-abuse victims. In 33 percent of cases, the allegations were considered false, and in 17 percent of cases, investigators could make no determination. A 1995 study by University of Michigan social work researcher Kathleen Faller found that of allegations in 215 child-sexual-abuse cases, about 70 percent were considered likely to be true, 20 percent were unlikely to be true, and about one in 10 was uncertain. Studies in 1986 and 1991 yielded similar results….In Ms. Faller’s 1995 study, 40 parents who raised sexual-abuse allegations-none of which were judged knowingly false-experienced negative sanctions, including losing custody to the alleged offender, limitation or loss of visitation, and court admonitions not to report alleged abuse again to the court, child protective services, or police. Such cases often turn on Dr. Gardner’s “parental alienation syndrome.” WORLD reviewed histories on 13 PAS cases…court records show the mother had already been found a fit parent, and was in most cases already the primary custodial parent. In all 13, court-appointed psychologists ignored children’s testimony of sexual abuse, and in some cases, medical findings of abuse, and even previous sex-offender violations. The prevalence of sexual abuse is so extensive that in “no sub-group is it clearly absent or rare” (Finkelhor, 1993, p 67). Around 80 per cent of the time, the offender is known to the child, and a third of sexual offenders are themselves adolescents.
