Retired Kentucky priest pleads guilty in church abuse cases as trial about to begin Lori Burling, 3/31/03 Louisville, Ky. (AP) “A retired Roman Catholic priest accused of abuse by dozens of plaintiffs pleaded guilty to multiple counts of sexual misconduct Monday as his jury trial was scheduled to begin. The Rev. Louis E. Miller, 72, of Louisville…50 counts of indecent and immoral practices and sexual abuse. The charges involve 21 victims…Miller retired from public ministry last year when the accusations became public. He is accused of abuse in more than 80 lawsuits filed against the Roman Catholic Archdiocese of Louisville, which employed him for more than 30 years…..They say the church was aware of the abuse but did nothing to stop it. A 1990 psychiatric report filed with the court last summer said Miller committed assaults every other month during the 1960s and ’70s, usually targeting boys 10 to 15. Kelly knew of abuse, kept priest in post – Memos show Creagh admitted molesting boy By Peter Smith The Courier-Journal “In March 1983, Louisville Archbishop Thomas C. Kelly became aware that a local pastor had sexually molested a 15-year-old boy but allowed the Rev. Thomas Creagh to continue leading St. Albert the Great parish. Two memos written for his own file, and initialed or signed by Kelly on March 9 and June 14 in 1983, show that the archbishop was fearful of church scandal and worked to keep the incident from becoming public. More than 200 people have suits pending against the Roman Catholic Archdiocese of Louisville alleging decades of sexual abuse by 34 priests, teachers and others associated with the church. Whether their cases proceed depends in part on their lawyers’ argument that the state’s statute of limitations should not apply because the archdiocese covered up the sexual abuse.” http://www.courier-journal.com/

From LMS Priest’s crimes hushed – Admission at trial By Sam Pazzano – Toronto Sun 4/15/03 “The bishop for a Northern Ontario diocese admitted in court he told parishioners that a priest was taking a sabbatical when in fact the priest was at a New Mexico treatment centre for sex abusers. Bishop Jean-Louis Plouffe told a civil trial yesterday that he gave the parishioners of Rev. Thomas O’Dell’s church “no more details” in May 1990 after he learned the priest allegedly committed acts of gross indecency against two teen brothers in the early 1980s. In 1992, O’Dell admitted committing those offences and was sentenced to six months in prison and two years probation….Plouffe also admitted he destroyed documents sent from O’Dell’s treatment centre because its staff had instructed him to do so. O’Dell…is now serving a 30-month sentence in a Kingston penitentiary for those crimes, described by Justice Robert Boissoneault as “depraved and callous.”

This may be very heavy for survivors From LMS Abused seeks $4M Priest in prison for ’80s assaults By Sam Pazzano, Toronto Sun “A former Catholic priest and his diocese are being sued for almost $4 million in a Toronto courtroom for the “depraved and callous” sexual abuse of a young teen almost 20 years ago. According to a statement of claim, Father Thomas O’Dell stripped the 13-year-old boy, pinned him atop a church altar and forced him to fellate him. The Catholic priest later sodomized the youth with a wooden crucifix while in his office. O’Dell is now serving a 30-month sentence in a Kingston penitentiary for the attacks, which a judge branded as “depraved and callous.” http://www.canoe.ca/TorontoNews

Priest told N.H. boy his father died for reporting alleged abuse By Larry Laughlin Concord, N.H. (AP) – “A Roman Catholic priest told a boy his father had died because the father had reported the priest’s alleged sexual abuse of the boy to the Manchester Diocese, according to a report released by state investigators Monday. The alleged victim, who was not identified, wrote to the Rev. New Jersey – Camden Diocese agrees to settle sex abuse lawsuit for $880,000 3/14/03 By Mary Jo Patterson Star-Ledger Staff “After spending nine years fighting claims that some of its priests had sexually abused children, the Roman Catholic Diocese of Camden announced yesterday that it would pay 23 plaintiffs $880,000 to end the case. $300M Priest Abuse Suit Filed AP 4/14/03 “Nearly two dozen victims of alleged sexual abuse by priests in the Diocese of Rockville Centre filed a $300 million lawsuit against the accused abusers and the church hierarchy…”…State Supreme Court in Mineola, seeks $100 million in compensatory damages, $100 million in punitive damages and $100 million for pain and suffering. The victims claim the diocese did nothing to protect them from abuse and that the church sought to protect its own reputation rather than comfort the victims. Priest sought help, instead was assigned to youth work By J.M. Hirsch, AP 2/15/03 Concord, N.H. (AP) “Six years after being ordained in 1970, the Rev. Paul Aube realized he had a serious problem. The Roman Catholic priest couldn’t control his sexual urges, he says, and had molested several teenage boys. Needing help, Aube blew the whistle on himself. He says he told his superiors that he’d had sexual contact with the teens, asked his bishop for psychological counseling, and requested to never again be assigned to work with children. That didn’t happen, he says. Hart of the Diocese of Norwich, Conn. – the seventh American bishop to step down since the clergy sexual abuse crisis erupted last January….Hart had come under increasing scrutiny for his role in the abuse scandal, and he is named as a defendant in several lawsuits filed in Massachusetts and Connecticut that accuse him of negligence in his supervision of abusive priests. Church documents made public last year show that Hart played a role in the cases of several accused priests, including the Rev. Benjamin McMahon, who was arrested in the mid-1980s and accused of performing a sex act with another man, but received favorable treatment in court after Hart intervened. Dioceses Resist Releasing Names of Accused Priests By Laurie Goodstein – Cleveland 2/26/03 “When a grand jury looking into sexual abuse by members of the Catholic clergy finished its work in December, it reported that it had uncovered accusations against 145 priests. But the panel indicted just one of them…” The grand jury investigated accusations against not only the 145 priests, but also 351 laypeople affiliated with or employed by the church, including teachers, principals and volunteers. Of the laypeople, only the 10 who were indicted had their names released. Church offers $4m payout for abuse 3/17/03 “Fifty-six men allegedly abused as boys at a Christchurch Catholic residential school are being offered compensation payments totalling $4 million. The St John of God Order hopes the payments – the largest ever offered by a religious order in New Zealand – will bring a “sad and sorry situation to closure”. Sweeney that they intend to elicit testimony from Elizabeth Loftus, a professor at the University of California, Irvine, to defend the church against charges that the Rev. Paul R. all accusations are alleged – UCI Professor Faces Pending Lawsuit – Controversial psychologist is accused of libel and invasion of privacy by alleged abuse victim – Jamie Claridad “UCI’s Distinguished Professor in Social Ecology Elizabeth Loftus, widely known for her studies in false memory research, is currently facing an impending lawsuit filed against her by Nicole Taus in Solano County, Calif….Although Taus could not be reached for comment, a plaintiff report filed at the superior court of California in Solano County accused Loftus and several other parties of invasion of privacy, defamation, libel per se, negligent and intentional infliction of emotional distress and damages. Taus, who is now currently serving as a Lieutenant in the United States Navy Air Corp, was caught between a custody case battle between her parents in 1979 that was later won by her father….David Corwin M.D. to publish an article in 1997 in the scientific journal “Child Maltreatment,” dealing with Taus’ memories on childhood abuse. Taus was not named, nor identified in the article, except as “Jane Doe.” The article drew interest. The journal then printed reviews including both praise and criticism that was published in the same journal. It was this journal article that allegedly prompted further research on Taus conducted by Loftus and Melvin Guyer, a psychology professor at the University of Michigan Medical School. from Lynn Crook with permission to republish (all accusations are alleged) : I am preparing a response to Jamie Claridad’s article, “UCI professor faces pending lawsuit” published in UC Irvine’s student newspaper, “New University,” on April 7, 2003. Here are some of the issues I will be addressing.

1. Dr. David Corwin was not “attracted” by a custody battle. Instead, he was asked to evaluate the case based upon a recommendation by Taus’ maternal grandmother.

2. The statement, “Taus claimed initially that while viewing the tapes, she had no recognition of the said events but later said that she did remember” is incorrect. Taus actually recalled a memory while being videotaped. The Corwin et al article should be online by the end of April. Readers may want to review this article and compare it to Loftus and Guyer’s account in “Skeptical Inquirer” which, as of April 3, 2003, was online at Loftus’ UW website.

3. I was never “subject to a custody trial between” my parents. Had Loftus testified at such a trial though, she would have done so at about the age of 10. We’re approximately the same age.

4. Loftus says that I signed up for a class of hers under a false name. However, I haven’t attended a college class since completing grad school in 1970. Loftus may be referring to the 2002 FMSF two-day conference in Illinois at which she was one of many speakers. I registered for this conference under my maiden name.

5. I did not say to the reporter, “Her work has created many enemies.” Nor did I say that Loftus’ actions “drew outcries from university officials prompting her to resign from the University of Washington and the American Psychological Association.” (I expect Loftus to respond unfavorably to this statement.) One quote is accurate. I said that Loftus’ testimony in Crook v. Murphy helped me win the case.

Shanley civil trial by questioning the repressed memories of plaintiffs claiming the priest raped them years ago, a man who has gained near folk-hero status among sexual abuse victims says his long-buried memories are real. And, says Frank Fitzpatrick, who hunted down former priest James R. Porter 11 years ago and was the first to accuse the now-convicted pedophile of abuse…But the case for repressed memory may be strengthened if incidents can be shown where abusers have admitted crimes long recessed in victims’ minds, advocates say. “Certainly, the fact that some perpetrators have admitted to abuse in these cases proves beyond a doubt that repressed memories can and do happen,” said David Clohessy of the Survivors Network of Those Abused by Priests….Rev. James L. Gummersbach did specifically admit to the abuse recalled in a repressed memory when he gave a written apology to Henry Bachmann for molestation occurring in a St. Louis, Mo., church in 1964, Bachmann’s lawyer, Rebecca Randles, said.” In terms of repressed memory, that case was absolutely clean. There was no prior counseling,” she said, discounting the notion a therapist could have “planted” the memory in her client’s mind by suggestive questioning. According to authorities, the children, ranging in age from 6 to 17, were raped, beaten, forced to watch pornographic torture videos and threatened and bribed to keep quiet. The number of categories of traumatic memory recalled increased with the total administered dosages of stress hormones (both catecholamines and cortisol), and the evaluation of these categories at different time points after discharge from the ICU showed better memory consolidation with higher dosages of stress hormones administered. However, the administration of stress doses of cortisol to critically ill patients resulted in more complex findings as it caused a significant reduction in PTSD symptoms measured after recovery. This effect can possibly be explained by a differential influence of cortisol on memory. Increased serum cortisol levels not only result in consolidation of emotional memory but are also known to cause a temporary impairment in memory retrieval which appears to be independent of glucocorticoid effects on memory formation. The feeling is one of being present but not consciously aware of oneself or one’s surroundings and is characterized by memory loss and a sense of disconnection. For victims of trauma, experts say, dissociation is often lifesaving. But when the dissociative response is called on repeatedly, especially in early childhood, the defense can become fixed and ingrained, disrupting normal functioning and undermining emotional and physical well-being. The most common cause is chronic child maltreatment – physical, emotional or sexual abuse.”
