Calif. to Drop Some Molestation Charges San Francisco (AP) 6/03 “The state attorney general said convictions will be overturned or pending charges dropped for about 800 accused child molesters in California after the U.S. Supreme Court ruled that statutes of limitations cannot be erased retroactively. The Supreme Court on a 5-4 vote Thursday overturned the nation’s only law designed to ensnare molesters who committed their crimes decades ago. Lawyers said the ruling nullifies most pending clergy sex abuse prosecutions in California. CALIFORNIA – CERTIORARI TO THE COURT OF APPEAL OF CALIFORNIA, FIRST APPELLATE DISTRICT No. 01–1757. Argued March 31, 2003-Decided June 26, 2003 In 1993, California enacted a new criminal statute of limitations permitting prosecution for sex-related child abuse where the prior limitations period has expired if, inter alia, the prosecution is begun within one year of a victim’s report to police. A subsequently added provision makes clear that this law revives causes of action barred by prior limitations statutes. In 1998, petitioner Stogner was indicted for sex-related child abuse committed between 1955 and 1973. At the time those crimes were allegedly committed, the limitations period was three years. Stogner moved to dismiss the complaint on the ground that the Ex Post Facto Clause forbids revival of a previously time-barred prosecution. The trial court agreed, but the California Court of Appeal reversed. The trial court denied Stogner’s subsequent dismissal motion, in which he argued that his prosecution violated the Ex Post Facto and Due Process Clauses. The Court of Appeal affirmed….93 Cal. The six California temples were also named as parties in the suit, which seeks millions of dollars in damages on behalf of more than 90 alleged victims. An attorney for the victims said the number could rise to as many as a thousand. Victims were subjected to “the most unthinkable abuse and maltreatment of little children which we have seen. Dirty mac image hides truth about child abuse 6/6/03 Reuters By Marie-Louise Moller “Brussels…In a new report, Save the Children also highlighted the potential threats to children posed by the Internet, where child pornography is widely distributed and one in five children under 18 years old are solicited for sex by adults in chatrooms. “People who sexually abuse come from different educational backgrounds, age groups and all socio-economic levels in society,” the report said….recent cases in Europe and the United States have revealed organised networks trading in child pornography and people making millions of dollars selling sex with children. In one Danish case, a stepfather and his wife were charged with sexually abusing their 11-year-old daughter and trading pictures of the abuse over the Internet. The girl was also trafficked both within Denmark and abroad to be sexually abused. Woman who claims she was molested by Catholic priest files suit 6/24/03 “Baker, 55, has pleaded innocent to 34 counts of child molestation in connection with a boy he allegedly abused during the 1970s and 1980s. Investigators believe there are nine or more victims.” “The woman said the alleged abuse by Baker began in 1984 and continued two years later when Mahony said he met with the priest and then sent him to treatment for his behavior. The Swales brothers say they suffered sexual abuse at the hands of Glendinning during visits to the seminary and on camping trips and other outings. Glendinning pleaded guilty in 1974 to gross indecency involving children. Even though this may not happen often, and most people who were abused during childhood remember part or all of the abusive experiences, adults can forget and then later remember childhood abuse. This has been documented in a variety of research and clinical reports, but additional studies are needed to determine the precise processes and mechanisms that occur during this situation. Assuming that any delayed recall of memories must be false would be inappropriate. There is no scientific evidence to indicate that delayed recall of childhood abuse memories are implanted or induced by psychologists, but it is accepted that pseudo memories of abuse can also occur at times. Dr Richard A. Gardner – Child psychiatrist who developed the theory of Parental Alienation Syndrome 5/31/03 (deceased 5/25/03)””Parental Alienation Syndrome”. The theory – one of the most insidious pieces of junk science to be given credence by US courts in recent years – holds that any mother who accuses her spouse of abusing the children is lying more or less by definition. She tells these lies to “alienate” the children from their father, a shocking abrogation of parental responsibility for which she deserves to lose all custody rights in favour of the alleged abuser. This is not only tawdry logic, guaranteed from the outset to protect the interests of divorcing fathers, by far Gardner’s most enthusiastic constituency, but it has also destroyed the lives of hundreds, maybe thousands, of American families over the past 15 years. In state after state, courts deferred to Gardner’s academic credentials and put children in the custody of their alleged abuser, even in cases where police records, medical records and testimony by teachers and social workers supported the mother’s accusations. By now, the concept of “parental alienation” has entered case law and swayed thousands of disputes in which Gardner himself played no part. Their testimony included alleged acts of abuse, sodomy and bizarre sexual games.” “The movie, said Boklan in a later telephone interview, “is a brilliant piece of fiction and theater but unfair and inaccurate.” She cited a Geraldo Rivera show in 1989 in which Jesse — already in prison at that point – admitted he had abused those children. But the scene, she says, is left out of the movie.” “Galasso also strongly rejected the idea that interviews with the children were designed to coax preconceived answers. The first detective sent out to interview one 10-year-old boy was surprised when the boy – upon meeting the detective – immediately handed him a flier that advertised Elaine Friedman’s in-home day-care center. According to Galasso, the boy told the detective he wanted him to have the poster because “‘I don’t want any more children to get touched.'” “What that young man eventually revealed,” Galasso continued, “was a pretty complete account of how he was seduced and then raped by Arnold Friedman and then Jesse Friedman.” The 10-year-old’s older brother, who also attended classes with Arnold Friedman, “told the same story, by the way,” Galasso said. Two-person teams began interviewing “a great number of children within a very short period of time,” she said. Lurid accounts surfaced of games of “leap frog” in the nude and “find the M&M’s,” which involved children using their mouths to find candy hidden inside other children’s underwear.”
