The purpose of the Clause is to protect citizens from arbitrary government action changing the legal status of actions that occurred in the past. Abuse victims were deeply and understandably upset by the decision in Stogner. As a result of the ruling, predators bound for prison got off scot free….Children often live with the ugliness of child abuse for years, held within themselves, precisely because they are not certain exactly what happened, or how to judge it. The Massachusetts attorney general called the figures “staggering” Wednesday as he issued a report with the findings….The cardinal was aware of the abuse even before he arrived in Boston as archbishop in 1984, and he and his inner circle were actively informed about complaints against numerous priests. Catholic Priest sentenced to 12 years in jail 7/25/03 “A Catholic priest has been sentenced to 12 years in prison for sexually abusing nine children. The court has also ordered Santiago’s Archbishop to pay a fine of some $71 000 for his role in covering up the crime. For the first time, the head of the Catholic church in Chile yesterday was held partially responsible for crimes committed by a priest…Jose Andres Aguirre Ovalle (‘Father Tato’), the priest, was sentenced to 12 years in prison for raping at least 10 children from 1998 to 2002.” http://www.sabcnews.com/

Rev. Dr. Edwin Cassem accused church leaders, particularly Bishop John B. McCormack, of concealing the information….he was appalled to learn that church officials had apparently ignored his advice and reassigned some abusive priests to active ministry after he recommended that they be kept away from parish work. The list of priests Cassem evaluated includes some of the archdiocese’s most notorious abusers, including the Rev. Paul R. Shanley, who is facing criminal charges for allegedly raping young boys. Presbyterians appoint committee to probe abuse allegations of missionary children AP 7/15/03 Louisville, Ky. “The Presbyterian Church (U.S.A.) will appoint a committee to investigate allegations of physical and sexual abuse of missionary children in Africa between the 1950s and 1980s. Jail for monk who tortured pupils By Auslan Cramb 7/15/03 “A monk who tortured pupils at a residential school in Stirlingshire for troubled children was jailed for two years yesterday. A former night-watchman at the school who sexually molested boys was given the same sentence and a former woodwork teacher will be sentenced for offences of indecency today. Michael Murphy, 69, known as Brother Benedict at St Ninian’s List D school in Stirlingshire in the 1960s and 1970s when the offences took place, had been convicted of 10 charges of physical abuse.” http://www.telegraph.co.uk/

A Diocesan ‘Shell Game’ $5M Lawsuit Targets Bishop’s Perks, Lack Of Salary 7/16/03 By Stephanie Saul “Bishop Thomas Daily presides over the Roman Catholic Diocese of Brooklyn, a job with perks – a staff, first-class travel and the use of a mansion. How Ireland Hid Its Own Dirty Laundry By Mary Gordon “The Magdalene Sisters,” by the Scottish director Peter Mullan…The film follows three young Irish girls who are sent to one of the Magdalene Asylums, institutions run by nuns, primarily in Ireland, to house girls who got pregnant outside of marriage, or who were considered too sexual, too flirtatious or even too attractive. They were incarcerated in these asylums, which doubled as laundries, where they worked, unpaid, seven days a week, 364 days a year, with only Christmas day off.” http://www.nytimes.com/

Sex Crimes Cover-up by Vatican? Los Angeles, 8/6/03 “The confidential Vatican document, obtained by CBS News, lays out a church policy that calls for absolute secrecy when it comes to sexual abuse by priests – anyone who speaks out could be thrown out of the church. The policy was written in 1962 by Cardinal Alfredo Ottaviani. The document, once “stored in the secret archives” of the Vatican, focuses on crimes initiated as part of the confessional relationship and what it calls the “worst crime”: sexual assault committed by a priest” or “attempted by him with youths of either sex or with brute animals.” Bishops are instructed to pursue these cases “in the most secretive way…restrained by a perpetual silence…and everyone {including the alleged victim) …is to observe the strictest secret, which is commonly regarded as a secret of the Holy Office…under the penalty of excommunication.” http://www.cbsnews.com/stories/2003/08/06/eveningnews/main566978.shtml

from LMS Vatican told bishops to cover up sex abuse – Expulsion threat in secret documents by Antony Barnett 8/17/03 “The Vatican instructed Catholic bishops around the world to cover up cases of sexual abuse or risk being thrown out of the Church. The Observer has obtained a 40-year-old confidential document from the secret Vatican archive which lawyers are calling a ‘blueprint for deception and concealment’…. The 69-page Latin document bearing the seal of Pope John XXIII was sent to every bishop in the world. The instructions outline a policy of ‘strictest’ secrecy in dealing with allegations of sexual abuse and threatens those who speak out with excommunication. They also call for the victim to take an oath of secrecy at the time of making a complaint to Church officials. Sex Slavery Scandal Rattles Montenegro By Misha Savic Ap 7/7/03 Podgorica, Serbia-Montenegro “Respected local newspapers reported that politicians and other members of Montenegro’s ruling elite frequented the brothel and took part in orgies at which women were tortured. The republic’s top lawman, state prosecutor Bozidar Vukcevic, was assailed with calls for his resignation for allegedly using his own car to transport captive women….the case was dropped by another prosecutor, who said there was a lack of evidence and inconclusive witness statements. The move has touched off widespread talk of a cover-up, and the US, UN, Amnesty International and European security organizations have accused Montenegrin authorities of tolerating sexual slavery and human trafficking. Pedophilia: International Discovery Organization in Rome (AGI)- Rome, 7/23/03 “The military policemen of the operating department of Rome have uncovered an association commit a crime esoteric that it is hidden under the abbreviation “Fun Club.” The organizers of the group, that operated in Italy, Switzerland, USA, England and Denmark, had organizing a new sexual type of abuse on the children, the “kidswrestling”, based on bet and photographic services on meetings of struggle between nude children. Between the “suppliers of children” also an Italian, resident in Lombardy that, for these meetings, made available the daughter of nine years. Pears, K.C. “Contrary to prediction, children with relatively high dissociation scores did not differ in their memory for charged and neutral pictures under divided attention when compared to children with low dissociation scores. Consistent with predictions, under divided attention, abused children remembered fewer charged pictures relative to non-abused children. The same pattern was found when comparing abused children with high dissociation scores to non-abused children with low dissociation scores. What film maker Andrew Jarecki omitted from “Capturing the Friedmans.” This has graphic descriptions of abuse. 1. In 1986, Arnold ordered a magazine called “Boy Love” featuring graphic pictures of men having sex with children. This mail order initiated the sting. 2. Child-sized dildoes were found in a cabinet just outside the classroom. Pornographic magazines were found on classroom shelves. 3. 140 children, ages 7-12, disclosed. Jarecki aired an interview, a young man seductively posed who said he’d recalled the abuse only after hypnosis. In 1989, some of the boys still wet their beds, took baseball bats to bed, were unable to sleep. 4. Jesse disclosed that when he was 8-9 he found his father’s stash of kiddie porn. Later, his father visited him at night in his bedroom and began to fondle, eventually sodomize him. Jesse started using drugs at 16 and was soon stoned on a daily basis. He started therapy at 10 and was diagnosed manic depressive. He had no friends, at 5’6″ he ballooned to 175 pounds. Jesse said in a 1989 interview that he was “halfway between loving and hating” his father. He said, “He let me down as a father.” 5. Mrs. Friedman said of her workaholic, undemonstrative husband that he was almost in tears when police took his pornographic photos. 6. Parents were told there was no need to enter the classroom. 7. The boys played “Simon Says,” nudity and fondling were demanded. 8. Threats reported by boys included: Arnold would burn down their house, kill their parents if they told. 9. Arnold and Jesse admitted to molesting 13 boys. Arnold pled to 8 counts of sodomy and 28 counts of first-degree sexual abuse. Jesse pled to 17 counts of sodomy and 4 counts of first degree sexual abuse. 10. Ross Goldstein, Jesse’s friend, pled to 3 counts of first-degree sodomy and one count of using a child in a sexual performance. 11. Friedman also admitted ramming one young boy’s head into a wall while other students watched. “Arnold and Jesse Friedman were arrested Nov. 26, 1987 ….Arnold ….pleaded guilty that same month before Boklan to 42 counts of sexually abuse involving 13 boys and was sentenced to 10 to 30 years in prison to run concurrently with the federal time. Jesse Friedman pleaded guilty Dec. 20 to 17 counts of first-degree sodomy; four counts of first-degree sexual abuse; one count of first-degree attempted sexual abuse; one count of using a child in a sexual performance and two counts of endangering the welfare of a child. In the plea bargain, Jesse Friedman gave up the option of appealing the case and was promised the sentence imposed yesterday. They found a foot-high stack of child pornography….child-sized dildoes in a cabinet just outside a makeshift classroom.” “Police said that 140 children – ranging in age from 7 to 12 – would finally admit what they had been too shamed and afraid to tell their parents. Some of them still wet their beds, take baseball bats to bed with them or are unable to sleep….the children were introduced to the pornographic computer discs….Det. Sgt. Frances Galasso, head of the Nassau sex crimes unit, said the Friedmans had the children mimic the actions of the computer figure in “Talking Sam.”….As a reward for keeping quiet, children were allowed to take computer discs home to copy. In a few cases, police found such discs in the homes of Friedman’s students….And the children were warned that if they told anyone what was going on there would be no more computer classes in Great Neck, Arnold Friedman would go to jail and it would be all their fault….Refusals to cooperate were punished by Arnold and Jesse. “I remember once they banged some kid’s head against the wall and said this will happen to you,” a 12-year-old boy who attended the classes two years ago said in an interview….”Jesse used to sneak up from behind me and he would slide his hands the same way his father did. First he would touch my shoulders then down my chest and into my pants.” “Then in March, 1986, friends of Jesse joined in what police said escalated into orgies of sexual abuse. Arnold and Jesse Friedman and three teens would sometimes attend classes with five to 10 students. Victims recounted being held down by one attacker and raped by another. Interesting, but Not Quite Accurate 7/27/03 Paul Vitello “The documentary film “Capturing the Friedmans” won the Best American documentary prize at the Sundance Film Festival this year, which might imply that it is a true story.” “There are too many omissions, however, for it to fairly answer any of the particular or general questions it purports to ask.
