Memories called key in abuse suits – Delaware men say they repressed recollection of priests’ molestation By Beth Miller, The News Journal 4/3/07 The debate over how humans remember, repress and recover memories may soon reach state courtrooms, as two men who say they were sexually abused by Catholic priests in Delaware pursue civil suits. If not for the recovery of long-lost memories, the lawsuits — both alleging abuses that occurred more than 20 years ago — would be prohibited by Delaware’s civil statute of limitations, a law that sets a two-year deadline for filing such claims. Both plaintiffs, Eric Eden and Douglas J. McClure, say they buried the memories of the abuses for years, making them “inherently unknowable,” a claim that can prevail over the legal time limit. To win, the men must persuade a jury that it is possible for such memories to be inaccessible and that, once recovered, their memories are valid.” “Children do what they must to survive the abuse, they say, even if it means putting it out of their minds for decades, or forever. “I see that in my young patients every day — 4-, 5- and 6-year-olds who have just been abused, and the abuse is validated,” said Dr. Joy Silberg, coordinator of Trauma Disorders Services for Children at Sheppard Pratt Hospital in Baltimore. “If I ask them to try to remember that, they may say, ‘Don’t ask me. It hurts my brain.’ … They’re working at getting it out of their head. A few weeks later, they won’t tell you. … Your mind pushes it away until you can’t access it when you try.” “But proving that memories can be false does not prove that valid memories cannot be recovered. “There is not a single clinician who treats torture victims, veterans, car accident victims, rape victims, child abuse victims who has the notion that trauma does not wreak havoc with memory,” said Dr. Bessel A. van der Kolk, a psychiatrist who is the medical director of the Trauma Center at the Justice Resource Institute in Brookline, Mass. http://www.delawareonline.com/apps/pbcs.dll/article?AID=/20070403/NEWS/704030349/-1/NEWS01

Pope ‘did not help girls abused by Florence priest’ By Peter Popham in Rome 4/9/07 “But there was no space in his list for the abused women of the parish of Regina della Pace (“Queen of Peace”) on the outskirts of Florence. For more than three years, these women have been trying to persuade the Church to take vigorous action against a parish priest whom they say persuaded them to have sex with him when they were minors, and continued to do so regularly for years. Confronted by their testimony, the church authorities first transferred the priest to another parish, and then out of the diocese. But he remains a priest, and has received only token punishment.” http://news.independent.co.uk/europe/article2434945.ece

Italy row over Church abuse film – Pope Benedict says sexual abuse by priests has created deep wounds 5/21/07 “An Italian politician has sparked a furore by urging state broadcaster Rai to block the transmission of a controversial BBC documentary. The programme, aired in the UK in October, investigates the sexual abuse of children in the Catholic Church. Italian journalist Michele Santoro has asked to purchase the rights to the film to broadcast it on his talk show. But Mario Landolfi, who heads Rai’s parliamentary oversight committee, has asked Rai to prevent its transmission. The Panorama programme, Sex Crimes and the Vatican, has been Google Italia’s most popular online video choice since a version with translated subtitles was put online. http://news.bbc.co.uk/2/hi/europe/6678753.stm

Committee OKs bill for sex crime lawsuits – Plan seeks to open window for civil cases against perpetrators by Ken Lewis Juneau Empire A bill that would create a one-year window for lawsuits against perpetrators of decades-old childhood sex crimes passed the Senate Judiciary Committee on Monday, despite concerns voiced by an attorney representing Alaska Jesuits. Senators gave greater weight to the victims’ accounts of their suffering than to the assertion from Anchorage attorney Jim Gorski that the proposal is “a matter best left to the law as it currently exists in the state.” “The goal of this bill is to get access to the truth for the victims,” said Sen. Lesil McGuire, R-Anchorage. http://www.snapnetwork.org/legislation/alaska_committee_oks.htm

Del. Senate Passes Bill Extending Time for Sexual Abuse Lawsuits 04/05/2007 Dover (AP) “The state Senate on Wednesday unanimously approved a bill allowing victims of child sexual abuse more time to file civil lawsuits against their alleged abusers. Senators approved the bill on a 19-0 vote after 3 1/2 hours of testimony from victims of child sexual abuse and legal experts. The bill repeals the statute of limitations in civil suits relating to child sexual abuse cases and provides a two-year window in which victims of past abuse can bring lawsuits previously barred by the current statute. ” http://www.wboc.com/Global/story.asp?S=6329489&nav=MXEF

Deployment raises abuse risk in military families 5/14/07 New York (Reuters Health) “Children in military families are at greater risk of maltreatment after a parent is deployed to conflict areas — and after the parent returns, a new study suggests. The rate of child maltreatment doubled among Texas military families in the nine months after October 2002, when Congress gave President George Bush the go-ahead to send troops to Iraq, the researchers found. “Both departures to and returns from operational deployment impose stresses on military families and likely increase the rate of child maltreatment,” Dr. E. Danielle Rentz of the University of North Carolina in Chapel Hill and her colleagues write in the American Journal of Epidemiology. “Such increases in child maltreatment may also extend to families at risk of being deployed.” http://www.reutershealth.com/archive/2007/05/14/eline/links/20070514elin002.html

Sudan’s young endure “unspeakable” abuse: report By Evelyn Leopold 4/19/07 United Nations (Reuters) “Children in Sudan are press-ganged, coerced to join armed groups, raped and used as forced labor or sex slaves, according to a new report by humanitarian groups. The report, Sudan’s Children at a Crossroads, concentrates mainly on Darfur, where a conflict has been raging for four years, and southern Sudan, emerging from 20 years of war. “Children in Sudan continue to endure some of the most inhumane treatment found anywhere in the world,” said Kathleen Hunt, chair of the Watchlist on Children and Armed Conflict, on Wednesday. “Despite the end of the war in the south and recent signs of hope for a strengthened peacekeeping force in Darfur, many Sudanese children are not faring any better than they were four years ago,” Hunt told a news conference on the report, compiled by six humanitarian organizations. While Sudan’s military continues to deny the presence of children in its ranks, the report said its representatives have acknowledged that youth from other armed groups have recently been incorporated into the government armed forces. In Darfur, most rebel and militia groups recruit children, including the pro-government Arab militias known as the Janjaweed, the rebel Justice and Equality Movement and the Sudan Liberation Army. While reports of rape and maiming are prevalent in Darfur, Sudanese girls from other areas have been forced into prostitution or into domestic service in and out of Sudan.” http:// www.sudantribune.com/spip.php?article21456

Abuse of Indian children ‘common’ By Geeta Pandey BBC News, Delhi “Two out of every three children in India are physically abused, according to a landmark government study. Watchdog: Online Child Porn More Brutal By Yuxing Zheng AP 4/16/07 London “Child pornography on the Internet is becoming more brutal and graphic, and the number of images depicting violent abuse has risen fourfold since 2003, according to an Internet watchdog report published Tuesday. The British-based Internet Watch Foundation said in its annual review that it received nearly 32,000 reports of potentially illegal content on its hot line last year, marking a 34 percent increase from the previous year. “Although there is a volume issue, the worrying issue is the severity and the gravity of the images is increasing,” said the foundation’s chief executive, Peter Robbins. “We’re talking about prepubescent children being raped.” The foundation identified about 10,700 individual Internet addresses on 3,000 sites containing child pornography content. About 80 percent of the children in the abusive images are female, and 91 percent appear to be children under the age of 12, it said. More than three in five child pornography Web sites were hosted in the U.S., while nearly a third were based in Russia.” http://www.washingtonpost.com/wp-dyn/content/article/2007/04/16/AR2007041601372_pf.html

Choirmaster jailed for abusing children Steven Morris 4/26/07 Guardian Unlimited “The Church of England was today criticised for failing to report a self-confessed child abuser to police, enabling him to continue to work closely with children. Instead of contacting officers after choirmaster Peter Halliday admitted sexually abusing a boy, the church forced him to leave. The 61-year-old was then able to gain positions of trust within a prestigious church music school, where he worked alongside children and became a governor. He was today jailed for two and a half years for abusing three boys. Sentencing him at Winchester crown court, Judge Ian Pearson said it was “unfortunate” that the church had not contacted police.” http://www.guardian.co.uk/crime/article/0,,2066144,00.html?gusrc=rss&feed=1

Natives died in droves as Ottawa ignored warnings – Tuberculosis took the lives of students at residential schools for at least 40 Years Bill Curry and Karen Howlett – from Tuesday’s Globe and Mail 4/24/07 Ottawa “As many as half of the aboriginal children who attended the early years of residential schools died of tuberculosis, despite repeated warnings to the federal government that overcrowding, poor sanitation and a lack of medical care were creating a toxic breeding ground for the rapid spread of the disease, documents show. A Globe and Mail examination of documents in the National Archives reveals that children continued to die from tuberculosis at alarming rates for at least four decades after a senior official at the Department of Indian Affairs initially warned in 1907 that schools were making no effort to separate healthy children from those sick with the highly contagious disease.” http://www.theglobeandmail.com/servlet/story/RTGAM.20070424.wschools24/BNStory/National/home

from LMS Member of church demands an apology – Police were called over man handing out cards By David Yonke “A member of a North Toledo parish is demanding an apology from his pastor and the bishop after police were called to stop him from handing out cards honoring slain Sister Margaret Ann Pahl. “I feel I was being harassed, and the diocese owes me an apology,” Mike Drabik, a parishioner since 1993, said yesterday. “I wasn’t doing anything evil.” Mr. Drabik said he began handing out the cards “peacefully” in front of St. Hedwig’s Catholic Church on Lagrange Street about 15 minutes before the start of the 7 p.m. Mass on Maundy Thursday, the 27th anniversary of Sister Margaret Ann’s death. The pastor, the Rev. Marek Ciesla, came out and asked him to stop. Father Ciesla said yesterday that he confronted Mr. Drabik because the parishioner was passing out literature without permission. He said several people had complained to him about Mr. Drabik’s actions. “I told him it’s private property and this is not an appropriate time to bring anything like this,” Father Ciesla said. “My business is to protect the parishioners. I didn’t know what he was passing out, but I didn’t care. The first step was not taken – he did not ask for permission.””The homemade flyers, about the size of a business card, feature a black and white photo of Sister Margaret Ann, who was strangled and stabbed to death in the sacristy of the former Mercy Hospital on April 5, 1980 – Holy Saturday that year – a day before her 72nd birthday. Toledo priest Gerald Robinson was arrested and charged with her murder in April, 2004, and convicted in Lucas County Common Pleas Court in May, 2006. The 68-year-old priest, who lived in the St. Hedwig rectory from 1989-90, is serving a 15-years-to-life sentence at Hocking Correctional Facility in southern Ohio. In addition to the photo of the slain nun, Mr. Drabik’s cards carried a caption: “Sister Margaret Ann Pahl, April 5, 1980. Ritual Abuse Victim.”” http://www.toledoblade.com/apps/pbcs.dll/article?AID=/20070407/NEWS03/704070385

from LMS – Signs honoring priest stir criticism – 5/12/07 – Schmit interfered with 1980 probe of nun’s murder, group claims By David Yonke Blade Religion Editor – On the one-year anniversary of Toledo priest Gerald Robinson’s murder conviction, a victim’s advocacy group yesterday asked the City of Toledo to remove honorary street signs that pay tribute to a deceased church leader who allegedly interfered with the original 1980 murder investigation. Claudia Vercellotti, co-coordinator of the Toledo chapter of the Survivors Network of those Abused by Priests, asked that Mayor Carty Finkbeiner take down the signs designating a stretch of St. Clair Street “Monsignor Jerome Schmit Way…..SNAP officials said in a letter to Mayor Finkbeiner that the monsignor’s good works in the community do not outweigh court testimony that he obstructed the Robinson murder investigation. http://www.toledoblade.com/apps/pbcs.dll/article?AID=/20070512/NEWS16/705120404/-1/NEWS

from LMS Indiana Apologizes for Role in Eugenics by Ken Kusmer, AP Writer 4/13/07 Indianapolis (AP) -“An Indiana official publicly apologized for the state’s role 100 years ago in pioneering state-authorized sterilization of “imbeciles,” paupers and others it deemed undesirable. Health Commissioner Dr. Judith Monroe expressed regret on behalf of the state Thursday for its passing of the first such eugenics law. She also unveiled a historic marker that will stand across from the Statehouse. “It is one (law) that we do regret but we should not forget,” she said. In 1907, then-Gov. J. Frank Hanly signed a state law widely regarded as the first in the world to permit sterilization in a misguided effort to improve the quality of the human race. The practice was not ended until 1974. By then, Indiana had sterilized about 2,500 people; nationally, 65,000 people in 30 states were given state-authorized vasectomies, tubal ligations and other operations.” http://sfgate.com/cgi-bin/article.cgi?f=/n/a/2007/04/13/national/a011006D33.DTL

Non-Lethal Weapons: Terms and References – INSS Occasional Paper 15 – USAF Institute for National Security Studies – USAF Academy, Colorado “Acoustic, Infrasound. Very low-frequency sound which can travel long distances and easily penetrate most buildings and vehicles. Transmission of long wavelength sound creates biophysical effects; nausea, loss of bowels, disorientation, vomiting, potential internal organ damage or death may occur. Superior to ultrasound because it is “in band” meaning that its does not lose its properties when it changes mediums such as from air to tissue. By 1972 an infrasound generator had been built in France which generated waves at 7 hertz. Jehovah’s Witnesses Settle Abuse Cases By Rose French – AP Writer 5/10/07 Nashville, Tenn. “A victims’ rights group released documents Thursday that showed the Jehovah’s Witnesses recently settled civil suits with 16 people who claimed they were sexually abused by church elders or that church officials failed to act on abuse allegations. The group, called silentlambs, held a news conference in Nashville to demand that the denomination change its policy for responding to sex abuse reports. Settlements were reached in late February and early March, according to court records obtained by silentlambs and posted to the group’s Web site. Fourteen of the cases were filed in California; the other two were in Oregon and Texas…..There are about 1 million Jehovah’s Witnesses in the United States, and followers are known for distributing Awake! and Watchtower magazines door-to-door. Bowen also said Jehovah’s Witnesses have a long-standing policy of not reporting molesters to police. He claims that the denomination has a secret database of accused abusers that they have not shared with law enforcement officials. “They keep putting innocent kids and unsuspecting families at risk of horrible crimes because they value their secrecy and reputations more than they value children’s safety,” Bowen said. Since establishing silentlambs in 2001, Bowen says about 7,000 people who claim they were abused have contacted his group.” http://www.boston.com/news/nation/articles/2007/05/10/jehovahs_witnesses_settle_abuse_cases/

Jehovah’s Witnesses accused of building ‘paedophile paradise’ http://www.sundayherald.com/ By Torcuil Crichton – Sunday Herald “Scottish branch of world church alleged to have sheltered abusers and kept information from police – The Jehovah’s Witnesses Church in Scotland stands accused of sheltering child abusers and keeping secret files of known paedophiles within the organisation which it refuses to share with police. After a successful prosecution over child abuse within a Jehovah’s Witnesses family in Ayrshire, Scottish police are understood to be preparing to bring a further case to court in the northeast. The Jehovah’s Witnesses church, which has six million members around the world, has been convulsed by revelations that its elders have protected sex offenders, failed to report accusations to the police and even punished children and families making accusations.” http://www.silentlambs.org/education/jwaccused.cfm

Grandmothers arrested over ‘satanic sex abuse’ Richard Owen, Rome 4/25/07 “Three women teachers were among six people arrested today accused of sedating and sexually abusing children as young as 3 at a school near Rome. The teachers — two of whom are grandmothers who had taught at the school and at Sunday school for decades — are said to have taken part in the repeated abuse of 15 children aged 3 and 5 for a year, filming them in sexual acts with satanic overtones at the teachers’ homes and in a wood. The others arrested were a woman caretaker, a former producer of children’s programmes for the state television station RAI, and a local petrol pump attendant. The television producer is married to one of the arrested teachers. The alleged abuse — in the town of Rignano Flaminio, 25 miles (40km) north of Rome — came to light when some of the children began describing their “games” to their parents. They drew pictures of a “man in black” who wore a hood and drank his own blood, and said they had played a game in which “a wolf chases a squirrel and eats it”. They were warned that if they told their parents about the “games”, they would be “taken away from their mothers by devils”. If the truth were to come out and they were asked who had taught them to perform sexual acts, they were to say “my father”. The parents also reported bruising and swelling around their children’s genital areas and that they had returned home from school in a confused state. Police say that the children were given tranquillisers and told they were sweets. The six face charges including kidnapping, indecently assaulting minors, obscene acts and group sexual assault.” http://www.timesonline.co.uk/tol/news/world/europe/article1706265.ece

describes crimes – Italy rocked by satanic, drug-induced sexual abuse in kindergarten – Children say they were forced in satanic sexual abuse and forced to drink blood in rituals Sara Macchitella 4/26/07 “Six persons were arrested in Rome on Wednesday accused of sexually abusing 15 children from the age of three to the age of six at the nursery school “Olga Rovere” of Rignano Flaminio, in the vicinities of Rome. They are expected to be subjected to intense interrogations on Friday. The accused persons were arrested and passed their first night in isolation in a jail in Rebibbia, close to Rome. All six were arrested and accused of a number of offences which included the abduction of minors, sexual violence within a group, sexual violence on minors under the age of 10 and obscene actions in public places.” “The little victims described the dreadful scenes saying: “In the villa where they took us, a man cut his arm and coerced us to drink his own blood which he poured in a glass, with other substances. Then they made us do a series of strange games, sort of performances with masked adults and massages to female teachers with oil”. The parents were reportedly alarmed by signs of bruising and red swelling around their children’s genital areas, as well as by the dazed and confused state in which some of them returned home from school.” http://www.maltastar.com/pages/msfullart.asp?an=11655

describes crimes – Dog’s head ‘part of ritual’ 04/18/07 Pretoria – An 18-year-old youth was arrested on Wednesday for sending a package containing the severed head of a Chihuahua dog through the post, said Pretoria police. “It apparently was related to satanic belief,” said inspector Paul Ramaloko. The Pretoria youth was handed to police by his parents on Wednesday afternoon. A urine test had revealed that the boy had drugs in his system, said Marizda Kruger, chief inspector for the Society for the Prevention of Cruelty to Animals (SPCA) in Tshwane. ‘A disturbed young man’ She said he had initially told her that he sent the dog’s head as a scare tactic to someone he had met in a chat-room on the internet. The person had apparently angered him. He later told police it was related to satanic belief.” http://www.news24.com/News24/South_Africa/News/0,,2-7-1442_2100791,00.html

Exclusive: Did ‘Son Of Sam’ Have Help? Part I: ‘Son Of Sam’ Speaks Out 5/9/07 “”Recently, after 30 years, I received a letter from a person I remember from the past,” Berkowitz said. During our exclusive sit-down, Berkowitz revealed that letter was from a person who practiced satanic rituals with him during the time the “Son of Sam” turned his demonic beliefs into murder. When asked what the letter said, Berkowitz said, “He just asked how I was doing. It was just a very peculiar letter. It had some sayings on it that were just troublesome. I read between the lines.” When asked if it was possible this person may have been involved during the late 1970s killing spree, Berkowitz didn’t rule it out.” http://cbs2chicago.com/topstories/topstories_story_129022849.html

Researcher to speak on link between CIA and multiple personality disorder By: Jennifer Heshion, Collegian Staff 4/30/07 Section: News “According to a press release on April 25, 2007 Ross will discuss “CIA and military mind control experimentation by American psychologists and psychiatrists, including the use of hypnosis, LSD, sensory deprivation and isolation and brain electrode implants and the creation of Manchurian Candidate super spies.” In “Bluebird: Deliberate Creation of Multiple Personality by Psychiatrists,” Ross defines the Manchurian Candidate as an unwitting patient with a new identity created deliberately and implanted in the individual by the CIA. In addition, amnesia barriers are created to ensure no memory of the unethical experiments has occurred, and this person is used in simulated or actual operations. Included in Ross’ lecture will be accounts of how some experiments are used on unwitting civilians, even pregnant women and children. Ross’ research includes discovery of experimentation on terminal cancer patients, imprisoned drug addicts and sex offenders, psychiatric patients and military personnel. Ross’ lecture will be held at 4 p.m. in 227 Herter Hall at UMass and will include undergraduate research poster presentations on May 3 at 11:30 a.m. in the Tobin-Bartlett breezeway. The lecture is sponsored by UMass’s department of psychology and the Psi Chi Honor Society’s Fourth Annual Undergraduate Psychology Conference on May 2 to May 3.” http://media.www.dailycollegian.com/media/storage/paper874/news/2007/04/30/News/Researcher.To.Speak.On.Link.Between.Cia.And.Multiple.Personality.Disorder-2887107.shtml

False Shepherds: how to avoid con artists and other human wolves in shepherds’ clothing “One of the biggest and most painful problems that ritual abuse and mind control survivors encounter as they begin to recover, is that they were so brutally conditioned to obey their human controllers that they often have great difficulty relying on their own judgment.  It’s easier to rely on others to tell them what to think, do, and believe than to rely on their own judgment and gut instincts. Survivors may also feel insecure and may have alter-states that have polarized opinions, judgment, needs and mental/emotional triggers and conditioning. This web page was written by two survivors who were dangerously victimized and retraumatized by such con artists. The writers hope that this page will help fellow survivors and pro-survivors to avoid making similar mistakes in judgment.” http://naffoundation.org/False%20Shepherds.htm

National Organization for Women Admonishes Media for Giving Alec Baldwin a Platform for Misinformed Theories 5/3/07 “NOW is not surprised by the media giving Alec Baldwin a platform to defend his outrageous behavior toward his 11-year-old daughter, but we are concerned that he is being allowed to promote, without challenge, a discredited legal theory that could harm many women and children. The public deserves to know the truth about so-called Parental Alienation Syndrome, and responsible journalism dictates that celebrity opinion offered in self-defense be balanced by actual data and professional expert opinion. The truth is that Parental Alienation really is a dangerous and cleverly marketed legal strategy that has caused much harm to victims of abuse, especially women and children during and post divorce. This strategy, promoted actively by several “father’s rights” groups, has convinced many people, including some in the judicial system and the media, that the actions of a protective parent (usually the mother) are more harmful than the actual mistreatment inflicted by an abusive parent. The end result is public support (and an excuse) for the teary-eyed abusive parent, plus a willingness to believe that so-called parental alienation, and not the parent’s own behavior, led to the child’s anger toward that parent. Parental Alienation Syndrome (sometimes called simply Parental Alienation) is not recognized by any professional body. It is simply a legal defense (disguised as psychological phenomenon) designed by Dr. Richard Gardner in the late 1980s to protect fathers from consequences of their abuse.” http://www.now.org/issues/family/050307pas.html

Traumatic Stress Induces Brain Change in Children Michael Smith – Reviewed by Robert Jasmer, MD; Associate Clinical Professor of Medicine, University of California, San Francisco – Stanford, Calif., March 5 – Children with post-traumatic stress disorder, similar to adults, show physical changes in the brain, according to researchers here. In a pilot study of 15 children, higher PTSD scores and higher cortisol levels were significantly (P<0.05) correlated with relative decreases over time in the volume of the right hippocampus, reported Victor Carrion, M.D., of Stanford, and colleagues, reported in the March issue of Pediatrics. On the other hand, there was no correlation with changes in the left hippocampal volume, Dr. Carrion and colleagues found…..Primary source: Pediatrics Source reference: Carrion VG et al. “Stress Predicts Brain Changes in Children: A Pilot Longitudinal Study on Youth Stress, Posttraumatic Stress Disorder, and the Hippocampus.” Pediatrics 2007; doi:10.1542/peds.2006-2028 http://psychiatrictimes.com/psychiatryNews/showArticle.jhtml?articleID=197800148&cid=PT-news-extra-041207

Study: Kids less prone to false memories Ithaca, N.Y., 5/2/07 (UPI) “A U.S. psychological study suggests children are less prone to experiencing false memories than are adults. The finding by Cornell University psychologists Charles Brainerd and Valerie Reyna has implications for court testimony. Previous studies have indicated false memories of events were found to decrease with age throughout childhood and adolescence. In other words, as people grow into adulthood, their memory accuracy improves. But in the new research, Brainerd and Reyna discovered the incidence of false memory actually increases with age under certain circumstances. That suggests adults have less accurate memories than do children. Brainerd and Reyna said the reasoning behind the phenomenon is straightforward: Because children lack a sophisticated ability to connect the meanings of words or events, as compared with adolescents and adults, they are buffered from making the semantic relation memory mistake. The researchers said their finding might have significant implications for the credibility of child testimony. The research is detailed in the May issue of Psychological Science.” http://www.sciencedaily.com/upi/index.php?feed=Science&article=UPI-1-20070502-13490000-bc-us-falsememories.xml

Mothers File International Complaint Against the United States – On May 11, just before Mother’s Day weekend, ten mothers, one victimized child, now an adult,  leading national and state organizations filed a complaint against the United States with the Inter American Commission on Human Rights. Their petition claims that U.S. courts, by frequently awarding child custody to abusers and child molesters, has failed to protect the life, liberties, security and other human rights of abused mothers and their children. http://www.stopfamilyviolence.org/ocean/host.php?page=468

Court says Loftus actions “beyond the pale” By John Thomas – Editor Emeritus The National Psychologist – Vol. 16, No. 3 May/June 2007 Pages 1 & 5. “The California Supreme Court said that actions Elizabeth Loftus, PhD,. Took to discredit a case study article describing repressed memories may be ” considered beyond the pale” and ordered a trial to consider whether those actions constitute an invasion of privacy. The court held that there is sufficient evidence that Loftus misrepresented herself to a young woman’s foster mother in order to obtain confidential and intimate details about repressed memories of alleged sexual abuse to warrant a trial on privacy invasion issues. “We believe it is important to recognize that there are at lease some types of misrepresentations that are of such an especially egregious and offensive nature – and are quite distinguishable from the types of ruses that ordinarily may be employed in gathering news – that they properly may be considered ‘beyond the pale’ . . . even when the misrepresentation is made to friends or relatives of the subject of an inquiry who are under no legal obligation not to reveal private information,” the court found in a 5 – 2 ruling. Loftus, a University of California at Irvine professor of psychology and one of the world’s leading researchers in repressed memories, has denied that she misrepresented herself during an hours-long meeting with the former foster mother….The former foster mother said that she became suspicious during the interview with Loftus and later testified that she would never have told them some of the intimate details of her foster daughter’s life if she had known Loftus misrepresented her relationship with Corwin, with whom both she and Taus had a trusting relationship. “In our view,” the court wrote, “intentionally misrepresenting oneself as an associate or colleague of a mental health professional who has a close relationship with the person about whom one is seeking information would be a particularly serious type of misrepresentation, and one significantly different from the more familiar practice of a news reporter or investigator in shading or withholding information regarding his or her motives when interviewing a potential news source.” Further, the court added, “We believe that if a trier of fact were to find Loftus engaged in the particular type of misrepresentations alleged by (the former foster mother) the conduct properly could be found ‘highly offensive’ for purposes of the intrusion-into-private-matters tort and liability could be imposed upon Loftus.” Loftus told The National Psychologist that she is pleased that the court held all but one of the allegations lodged against her by Taus have been dismissed at the trial court level under California’s 1992 Strategic Lawsuits Against Public Participation (SLAPP) statute, which protects actions that fall within the constitutional rights of petition and free speech. Under that statute, Loftus is entitled to be reimbursed for the costs of appealing the case to the court of appeals and the state supreme court. “I’m gratified that the vast majority of claims were dismissed and the costs of defending those claims are to be reimbursed,” she said. Loftus added that if the invasion of privacy claim goes to trial she is confident she will be able to prove the allegations made by the former foster mother are untrue.” “Ot is too bad that scholars and scientists and journalists in the future may be forced to go to trial when someone falsely claims there was a misrepresentation,” Loftus said. “Journalists have long known about the dangers of ‘source remorse,’ which is why the major media filed an amicus brief on our behalf.”….Joyanna Silberg, PhD., of Baltimore, executive vice president of the Leadership Council on Child Abuse & Interpersonal Violence, said the ruling “supports the discipline of psychology by bolstering ethical and scientific research guidelines with the added authority of law.” The Leadership Council has filed an amicus brief supporting Taus. Silberg said the behavior Loftus is accused of is outside the boundaries of any acceptable research protocol. “There are ways to do scientifically acceptable research even on case studies, but not by defrauding people to gain confidential information surreptitiously,” she added.”

from BO Memory of childhood trauma before and after long-term psychological treatment of borderline personality disorder. Kremers IP, Van Giezen AE, Van der Does AJ, Van Dyck R, Spinhoven P J Behav Ther Exp Psychiatry 38:(1):1-10, 2007 “The present study investigated the consistency of self-reports of childhood
traumatic events in a sample of 50 patients with a borderline personality disorder (BPD) before and after 27 months of intensive treatment with schema focused therapy or transference focused psychotherapy. The mean number of reported sexual, physical and emotional traumatic events did not change following treatment. Test-retest correlations of the trauma-interview also indicated high stability of the total number of sexual, physical and emotional events reported.”
